Terms of Service

1. Acceptance of Terms

By accessing or using Camp Connect (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and use the Service. By using the Service, you represent that you meet this requirement.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Camp Connect is a software-as-a-service (SaaS) platform that provides camp management tools to organizations ("Organizations") including, but not limited to:

• Camper registration and enrollment management • Staff management and scheduling • Medical information tracking • Communication tools • Check-in/check-out systems • Activity and cabin assignments • Camp store management

The Service is a platform that enables Organizations to manage their camp operations. Camp Connect provides the tools; Organizations are responsible for their own operational decisions and activities.

3. Affiliated Organizations

Camp Connect provides camp management services for camps operated by Florida College and Hutchinson Bell Society, among other organizations.

When you use the Service for camps operated by these organizations, your use of the Service is also subject to any applicable policies of those organizations. Information you provide may be shared with these organizations as described in our Privacy Policy.

By registering through the Service, you acknowledge that Florida College may send you marketing communications about their programs, events, and services via email or direct mail. You may opt out of these communications at any time.

Features within the Service related to congregations, society memberships, or religious affiliations are provided to support the operations of camps that choose to use them.

4. Account Registration and Security

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Keep your password secure and confidential • Accept responsibility for all activities that occur under your account • Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights • Upload, transmit, or store any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable • Impersonate any person or entity or misrepresent your affiliation • Interfere with or disrupt the Service or servers • Attempt to gain unauthorized access to any systems or data • Use the Service to send spam or unsolicited communications • Collect or harvest personal information without consent • Use automated systems (bots, scrapers, etc.) without permission

We reserve the right to remove content or suspend access for violations of this policy.

6. Data Ownership and Responsibilities

Organizations retain ownership of all data they input into the Service ("Organization Data"), including camper information, staff records, and operational data.

By using the Service, you grant Camp Connect a limited license to process, store, and display Organization Data solely for the purpose of providing the Service.

Organizations are responsible for:

• The accuracy and completeness of their data • Obtaining necessary consents for data collection • Compliance with applicable privacy laws • Decisions made based on data in the system • Proper data handling and retention policies

Camp Connect is a data processor acting on behalf of Organizations. Organizations remain the data controllers and are responsible for their data practices.

7. Medical Information Disclaimer

IMPORTANT MEDICAL DISCLAIMER: The Service allows Organizations to store and manage medical information for record-keeping purposes only. Camp Connect:

• Does NOT provide medical advice, diagnosis, or treatment • Does NOT verify the accuracy of medical information • Does NOT replace professional medical judgment • Is NOT a healthcare provider or medical record system

Organizations are solely responsible for:

• Obtaining proper medical information from guardians • Making appropriate medical decisions during camp operations • Ensuring qualified medical staff review health information • Maintaining HIPAA compliance or other applicable regulations • Emergency medical response and procedures

Medical information in the Service is provided by guardians and Organizations. Camp Connect makes no warranties about the accuracy, completeness, or timeliness of medical data.

8. Intellectual Property

The Service, including its original content, features, functionality, and underlying technology, is owned by Camp Connect and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not:

• Copy, modify, or create derivative works of the Service • Reverse engineer, decompile, or disassemble the software • Remove or alter any proprietary notices • Use our trademarks without permission

Organization Data and content uploaded by users remains the property of the respective owners.

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CAMP CONNECT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMP CONNECT SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages • Loss of profits, data, use, or goodwill • Camp operations, activities, or events • Injuries or accidents occurring at camps • Medical decisions or outcomes • Actions or decisions made by camp staff • Errors in data entry by users • Third-party services or integrations

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Camp Connect, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service • Your violation of these Terms • Your violation of any third-party rights • Your Organization's camp operations and activities • Medical or health-related incidents at your camps • Actions of your staff or volunteers • Content you upload or transmit through the Service

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which Camp Connect is incorporated, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where Camp Connect is incorporated.

YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction.

12. Termination

You may terminate your account at any time by contacting us at support@fc-camp.com.

We may suspend or terminate your access to the Service immediately, without prior notice, for:

• Violation of these Terms • Non-payment of applicable fees • Conduct that we determine is harmful to other users or the Service • Upon request by law enforcement or government agencies

Upon termination:

• Your right to use the Service will immediately cease • You may request an export of your Organization Data within 30 days • We may retain certain data as required by law or for legitimate business purposes • We will delete your data in accordance with our data retention policy

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on our website • Sending an email to the address associated with your account • Requiring re-acceptance of Terms within the Service

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

If you do not agree to modified Terms, you must stop using the Service and may request deletion of your account.

14. Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Camp Connect regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
